The mediation in the field of insurance, and as a method of conflict management, aims to prevent the start of litigation, to end the one already initiated or to reduce its scope, making our client to save time and money inherent to court proceedings.

Mediation makes available to insurance companies and policyholders the necessary instruments to resolve conflicts.

Advantages of mediation:

i. Economy: it is less expensive than a judicial procedure and arbitration
ii. Speed: the process usually lasts a few months, sometimes even only a few weeks
iii. Final and fair agreements

Certain studies shown that more than 76% of the issues of an insurance nature correspond to the area of civil liability – such as traffic accidents, which account for about 40% of cases -, water damage (21.30%) or electrical damage (16.67%). Regarding the amount, in 50% of the judicial proceedings an amount equal to or less than € 1,644.50 has been claimed, and in 77% of the cases the amount is equal to or less than € 5,000.

These figures confirm that there are disputes in which the amount at stake is much lower than the cost of bringing the resolution of this type of controversy to court, presenting mediation as a very interesting alternative.
